Discrimination

Anti-discrimination laws are there to protect vulnerable people in our community. They operate when someone suffers, or is disadvantaged, because of a protected ground, such as race, sex, pregnancy, disability, sexual orientation, gender identity, parental or carer responsibilities, marital status, age, or any one of a number of other grounds.

Defamation

Defamation (what you might know as slander or libel) is the cause of action that protects a reputation in Australia. Small businesses and individuals are promoting themselves online more than ever before, and that means your reputation has never been more at risk.

Anything you publish about someone, or someone publishes about you, can be defamatory. If you’re an influencer or content producer, you need to know what you can say and be prepared for the worst if you publish content about someone or someone publishes about you.

Institutional Abuse

We act for survivors of child sexual and physical abuse. We believe that institutions should recognise wrongs and pay fair compensation to people who were abused as children in their care. We assist survivors of abuse to obtain compensation against the institution responsible for the abuse. We understand that survivors experience a range of significant and ongoing psychological, psychiatric and other consequences. We act for former Wards of the State, as well as those abused in religious institutions and out of home care. We have experience in dealing with the State of Victoria and religious institutions.

We understand that it is difficult for survivors to tell their story and we know that monetary compensation does not change what happened.

We provide advice about the legal rights of survivors, including access to the National Redress Scheme and victim of crime compensation.

The Prime Minister of Australia delivered the National Apology to Victims and Survivors of Institutional Child Sexual Abuse in October 2018. More information on this can be found here.

Privacy

Principal Lawyer

James is a highly regarded commercial lawyer. He has successfully brought claims against Australia’s largest banks, stockbrokers and financial institutions. He has also acted for unions subject to investigations by government agencies and has advised unions, industry superannuation fund directors and corporations on regulatory, governance and directorship issues.

James regularly presents on professional obligations and duties at industry conferences, and has provided his expert analysis in the media.

James also acts in estate dispute matters and testator’s family maintenance claims.

Carol Andrades
Consultant

Carol is widely acknowledged for her expertise in anti-discrimination law and also practises in industrial and employment law. She is an honorary Senior Fellow with the University of Melbourne’s Law School, where she lectures at post-graduate level in anti-discrimination law, and is on the Editorial Board of the Employment Law Bulletin.

Carol wrote the chapter on Freedom from Discrimination and Harassment in the Australian Charter of Employment Rights. She received the President’s award from the Australian Federation of AIDS Organisations for her advocacy in the Special Family Leave Test Case.

Philip Johnston

Phil is a litigation lawyer who applies his diverse skills working on a variety of matters including media law, sports law and commercial disputes. Phil also specialises in defamation matters. He works in Gordon Legal’s Commercial Law practice and has a history of working on complex, large-scale class actions as well smaller, bespoke litigation.

Fiona Rothville
Associate

Fiona is an experienced litigator who practises across the Industrial Law and Commercial Law teams. Fiona represents unions and employees in a range of employment and industrial matters, including in proceedings brought by industrial regulators. Fiona acts in various commercial and consumer disputes and provides representation in Coronial Inquests in respect of professional conduct.

Fiona has previously worked at the Fair Work Commission as a Conciliator and an Associate to a Deputy President and has a background in the union movement. Fiona is a volunteer and former board member of the Fitzroy Legal Service.

Marina Leikina
Associate

Marina is an experienced lawyer who works in employment and industrial law, as well as institutional abuse cases. Before joining Gordon Legal, Marina worked as a lawyer in regional Victoria, acting for workers and employees in personal injury and employment law matters.

Marina volunteers at West Justice in the employment law project that provides assistance to migrants and refugees.
