ACT Junior Doctors Class Action

Important class action update

Junior doctors in the ACT have reached a landmark $31.5 million settlement in their fight for unpaid overtime.

If you wish to participate in the Settlement Scheme, you must register your interest before 4:00pm on 27 November 2024. If you do not register, you will be unable to participate in the Settlement Scheme.

 

Have you worked unpaid unrostered overtime?

If you have worked as a Junior Medical Officer in the ACT at either Canberra Hospital and/or Calvary Public Hospital (now, North Canberra Hospital) at any time since November 2016 and performed unpaid unrostered overtime, you may be eligible to participate in the proposed Settlement Scheme.

A settlement agreement has been reached in the ACT Junior Doctors Class Action, which is subject to the approval of the Court. A settlement approval hearing is set on 18 December 2024 before the Honourable Justice Snaden. It has been agreed between the parties that the Australian Capital Territory and Calvary Health Care ACT will pay the following amounts to resolve the class action:

  1. $25,340,000 representing compensation to be paid to the Applicant and Group Members eligible to participate in the Settlement Scheme.
  2. $2,860,000 in respect of the legal costs and disbursements.
  3. $3,300,000 in respect of the costs of administration and distribution of the Settlement Sum to the Applicant and Group Members.

If the Court approves the settlement, Gordon Legal, together with Hayden Stephens & Associates, will be appointed as Scheme Administrator of the Settlement Scheme.

If you wish to participate in the Settlement Scheme, you must register your interest before 4:00pm on 27 November 2024.

You will be contacted regarding your eligibility to participate in the Settlement Scheme after the Court determines whether to approve the settlement. If you are assessed as eligible, the Scheme Administrator will issue you a Notice of Claim. We expect this will be in early 2025.

It does not cost anything to register.

You can register your interest if you have worked as a Junior Medical Officer in the ACT at either Canberra Hospital and/or Calvary Public Hospital at any time since November 2016.

Gordon Legal, together with Hayden Stephens & Associates, filed a class action in the ACT on behalf of Dr Ying Ying Tham, alleging that Canberra Hospital and Calvary Health Care (now North Canberra Hospital), failed to pay Doctors in Training for their unrostered overtime.

5 August 2024

Mediation held.

17 September 2024

Settlement deed executed.

18 December 2024

Settlement approval hearing.
